Welcome to ORTLIEB USA. The terms "ORTLIEB USA," "we," "us," and "our" refer to ORTLIEB USA LLC. We operate this website, store, and related services (collectively, the "Services") to provide customers with access to our products, information, and online shopping experience.
The Services are powered by Shopify, which enables us to offer ecommerce functionality and related services to our customers. By accessing or using our Services, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Return Policy, Warranty Policy, and any other policies incorporated by reference.

- Export resale activity
- Bulk purchasing intended for unauthorized commercial resale
Your order is not accepted until payment has been authorized and ORTLIEB USA has confirmed order acceptance.
All product returns and exchanges are governed exclusively by our Return Policy.

All prices are shown in U.S. dollars unless otherwise stated.
Prices may change without notice.
Applicable sales taxes will be collected where required by law. Shipping charges, taxes, and other fees will be displayed before checkout.

Shipping and delivery dates are estimates only and are not guaranteed.
ORTLIEB USA is not responsible for delays caused by shipping carriers, customs authorities, weather events, labor disruptions, governmental actions, or circumstances beyond our reasonable control.
Ownership of products passes upon receipt of full payment.
Risk of loss passes upon delivery of the products to the shipping address designated in your order.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
ORTLIEB USA's ecommerce platform is powered by Shopify.
Purchases made through this website are transactions directly between you and ORTLIEB USA.
Shopify is not responsible for any aspect of the sale, fulfillment, warranty, return, repair, or use of products purchased from ORTLIEB USA. This section should remain substantially consistent with Shopify's required language.

ORTLIEB USA reserves the right to correct errors, inaccuracies, omissions, pricing mistakes, inventory discrepancies, and product descriptions at any time, including after an order has been submitted.
We may cancel affected orders and provide appropriate refunds where necessary.

AI ASSISTANTS AND SHOPPING AGENTS
ORTLIEB USA is not responsible for recommendations, summaries, purchasing decisions, product selections, interpretations, or actions made by third-party AI assistants, shopping agents, autonomous systems, or digital assistants.
Customers remain solely responsible for reviewing product descriptions, pricing, specifications, availability, warranty information, and shipping details before completing any purchase.
SECTION 15 – TERMINATION
ORTLIEB USA may suspend or terminate access to the Services at any time for violations of these Terms or conduct that we reasonably determine threatens the security or operation of the Services.
Termination does not relieve users of obligations incurred before termination.
SECTION 16 – WARRANTIES
Certain ORTLIEB products may be covered by separate written warranties, repair programs, or product guarantees.
To the extent an express written warranty applies, that warranty governs the product covered by the warranty.
EXCEPT FOR EXPRESS WRITTEN WARRANTIES PROVIDED BY ORTLIEB USA, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these Terms shall limit rights that cannot be waived or excluded under applicable law.
SECTION 17 – LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORTLIEB USA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF THE SERVICES OR PRODUCTS.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, these limitations apply only to the extent permitted by law.
Nothing in these Terms excludes liability that cannot legally be excluded.
SECTION 18 – INDEMNIFICATION
You agree to defend, indemnify, and hold harmless ORTLIEB USA, its officers, directors, employees, affiliates, and service providers from claims, damages, liabilities, losses, and expenses arising out of:
- Your violation of these Terms;
- Your misuse of the Services;
- Your violation of applicable law;
- Your infringement of third-party rights.
SECTION 19 – DISPUTE RESOLUTION AND ARBITRATION
Informal Resolution
Before initiating legal proceedings, each party agrees to attempt good-faith resolution of disputes through informal discussions for at least thirty (30) days.
Binding Arbitration
Except for intellectual property disputes, small claims matters, or requests for injunctive relief, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Class Action Waiver
All claims must be brought solely in an individual capacity.
Class actions, collective actions, and representative actions are prohibited.
Jury Trial Waiver
To the fullest extent permitted by law, both parties waive the right to trial by jury.
SECTION 20 – SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
SECTION 21 – ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Return Policy, Warranty Policy, and other referenced policies, constitute the complete agreement between you and ORTLIEB USA regarding the Services.
SECTION 22 – GOVERNING LAW
These Terms shall be governed by and interpreted under the laws of the State of Washington, without regard to conflict-of-law principles.
Subject to the arbitration provisions above, any court proceeding shall be brought exclusively in the state or federal courts located in King County, Washington.
The parties consent to the jurisdiction and venue of those courts.
SECTION 23 – CHANGES TO THESE TERMS
ORTLIEB USA may revise these Terms at any time.
Material changes will be posted on this page together with an updated effective date.
Continued use of the Services following such changes constitutes acceptance of the revised Terms.
